OAG, the scheduled airline flight information provider, has now filed with the US Department of Justice (DoJ) a complaint regarding IATA and its relationship with the American company Innovata in a similar manner to its protest to the EU (see last week”s ABTN ” available on http://www.abtn.co.uk). The DoJ's Antitrust Division is roughly equivalent to the UK Office of Fair Trading/Competition Commission. Its primary concern is the protection of competition in the US market, and it has powers to apply US anti-trust laws to combat restrictive practices, such as price fixing, corporate mergers, or abuse of monopoly power. Breach of anti-trust law is both a civil and criminal offence, and the DoJ has extensive powers to prosecute violations in the courts, which can result in substantial claims for damages.
