PASSENGER denied boarding compensation (DBC), an EU regulation introduced last year, took an interesting twist last week, which was reported in ”The Times”. A would-be flyer brought a case against Thomas Cook Airlines claiming that the carrier had broken European law by moving a flight from Stansted to Manchester and then overnighting passengers before departing the following morning. The customer won, the district judge dismissing the counter argument in which the airline claimed technical reasons beyond their control. The case is unlikely to go to a higher courts as if Thomas Cook were to lose again it would set a precedent for future similar cases. With the small claims court this is not so.
